This website is operated by House of Tartufo SRL. Throughout the site, the terms “we”, “us” and “our” refer to House of Tartufo. House of Tartufo offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”), including those additional terms and policies referenced herein and/or available by hyperlink.

Section 1 – Online Store Terms
• By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction.
• You may not use our products for any illegal or unauthorized purpose.
• A breach of any Term will result in immediate termination of Services.

Section 2 – General Conditions
• We reserve the right to refuse service to anyone, for any reason, at any time.
• Your content (excluding credit card data) may be transferred unencrypted across networks. Credit card data is always encrypted.
• You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without our written permission.

Section 3 – Products and Nature of Truffles
• Truffles are natural, perishable, and seasonal products. Variations in size, shape, internal veining, and compactness are normal and do not constitute defects.
• Fresh truffles may present minor imperfections (such as wormholes or marks), especially at the end of the season. These do not make the product spoiled or inedible.
• Perfect compactness can only be expected in full season.

Section 4 – Prices and Payments
• All prices are listed in EUR, VAT included where applicable.
• Payment must be made in advance for all fresh truffles and perishable products.
• Advance payment is industry standard for perishable goods and does not imply lack of trustworthiness.

Section 5 – Shipping and Delivery
• Truffles are harvested daily and shipped fresh.
• Delivery times are estimates; we are not liable for courier delays.
• Risk of loss passes to the customer upon delivery to the agreed address.

Section 6 – Returns & Refunds (Key Clause)
Our Return & Refund Policy forms an integral part of these Terms. Key rules:
1. Non-perishable items (accessories, merchandise) may be returned within 30 days if unused, with original packaging and proof of purchase.
2. Perishable goods (fresh truffles) are excluded from the EU right of withdrawal (Directive 2011/83/EU, Article 16(c)) and are non-returnable and non-refundable once delivered.
3. Complaints must be submitted within 24 hours of delivery to admin@houseoftartufo.com, with:
• Photo of the whole truffle.
• Photo of the truffle cut in half.
• Photo of the defective part on a scale with visible weight.
4. If validated:
• We will replace the defective weight at our expense, OR
• Issue a credit note for the affected weight.
5. ⚠️ Full refunds are not available for fresh truffles or any perishable goods.

Section 7 – Accuracy of Information
• We strive to provide accurate information but cannot guarantee completeness or timeliness.
• Historical or seasonal information may vary.

• Our liability is limited strictly to the value of the order.
• We are not liable for damages due to improper storage by the client, natural variations of the product, or courier delays.
• Claims of “not edible” must be supported by proper evidence under our complaint procedure.

• Customers must provide accurate delivery details and ensure proper storage upon receipt.
• Excessive or inappropriate communication (e.g., repeated messages to private numbers, threats) will not be tolerated and may terminate the business relationship.

• These Terms are governed by the laws of Belgium and applicable EU law.
• Disputes fall under the exclusive jurisdiction of the courts of Brussels, Belgium.
